Notification of Infringement

If you believe that someone on psu.social has violated your copyright, you may send us a Notification of Copyright Infringement. For us to process such a notification, it must substantially comply with the requirements set forth in United States law. To speed our handling of your notification, please make sure it complies with the following criteria:

• Notifications may be submitted to our Registered Agent in one of two ways. You may send it via email (no attachments, please) to sysadmin@psu.social, or you may send it via physical mail to 1223 Wilshire Blvd #213, Santa Monica, CA 90403. We prefer to receive notification via email.

Takedown Process

When we receive a properly-formatted notice of copyright infringement, we will forward it to the account owner and provide a limited amount of time to disable access to the allegedly-infringing content.

If you have received this notice from us, this disabling can generally be done in one of two ways: you can delete the entry, comment, or image in question, or you can allow us to set the entry, comment, or image in question to non-viewable. Setting an entry's security to Private or screening a comment is not sufficient to qualify as 'disabling access' under the law, as this can be undone at any time.

If we do not hear back from you with information about which option you'd prefer within the length of time we provide for you to select an option (usually between 24-48 hours), we will assume that you would like for us to set the entry, comment, or image in question to be non-viewable, and we will do so. This will not affect the rest of your account.

You then have one of three choices:

• You can accept the allegation of infringement, and state that you will not restore the content, file a counter-notification, or make further infringement upon the work in the future. If you have received a notice of alleged infringement, you may not re-upload or re-post the allegedly-infringing material, unless you have gone through the counter-notification process. This applies whether you have deleted the material yourself, or you have chosen to allow us to disable access to the material. If you do re-upload or re-post the material, we will be forced to entirely disable your account.

Counter Notification

A counter-notification is a statement, under the provisions of 17 USC 512(g)(3), that you do not believe your content infringes on another person's rights, or that your use of another person's copyrighted material falls into one of the protected categories under law.

By filing a counter-notification, you are indicating that you are willing to defend your use of the material in court, if the copyright owner chooses to bring a lawsuit against you for your use of the material. This may involve civil and/or criminal penalties. We strongly suggest you contact an intellectual property lawyer licensed to practice law in your jurisdiction before you do this, so that you are aware of your rights and obligations under the law.

There are groups that may help you understand your rights and obligations, including the Chilling Effects Clearinghouse, the Electronic Frontier Foundation, and the Organization for Transformative Works. We are not affiliated with any of these organizations, and they may not be able to help you, but their mission and mandate involves educating people about their rights and obligations under intellectual property law.

A counter-notification must contain the following items:

• Your signature. Signatures may be a physical signature or a digital signature in a recognized industry-standard format such as PGP.
• The URL of your entry, comment, or image that has been called into question. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material. This should include any reasons why you believe your use of the material is not infringing.
• Your name, address, and telephone number.
• A statement that you consent to the jurisdiction of Federal District Court where you reside, or (if you live outside the United States) that you consent to the jurisdiction of Federal District Court where Chic 42 Enterprises, Inc. is located (currently Santa Monica, CA).
• A statement that you will accept service of process from the person who provided notification of infringement, or that person's designated agent.

Your counter-notification will be provided, in its entirety, to the person who provided notification of alleged infringement.

Restoration Process

When we receive a counter-notification, we will forward it to the person who made the original notification of alleged infringement. From that point, the original notifier has 10 business days after receiving the counter-notification to file an action in court, seeking an injunction against the use of that material.

If you have provided us with a notification of infringement, and the user of our service has chosen to file counter-notification, you must inform us that you have filed court action no more than 14 days after we forward the counter-notification to you. If you do not, we will re-enable access to the allegedly-infringing material no less than 10 days, and no more than 14 days, after we forward the counter-notification.

If you have received a notification of infringement, and you have provided us with your counter-notification, we will re-enable access to the allegedly-infringing material, or let you know that you can re-post the allegedly-infringing material, no less than 10 days, and no more than 14 days, after we have forwarded your counter-notification to the original notifier.

If you have filed a counter-notification, you can not re-upload or re-post the allegedly-infringing material until we notify you that the waiting period has expired. If you do, we will be forced to entirely disable your account during that time period.

Repeat Offenses

US law requires us to disable the accounts of repeat offenders of others' copyright. What constitutes a repeat offender is not defined by law.

We currently define a repeat offender as anyone who has received five valid notifications of copyright infringement. Instances where you have filed a counter-notification, or instances where you have indicated that you do not accept the allegation of copyright infringement but do not wish to file a counter-notification, will not count against your account for purposes of determining 'repeat offender' status. We reserve the right to alter this definition in the future, at our sole discretion.

We also reserve the right to terminate the accounts of those who, in our opinion, misuse or abuse the DMCA notification process against other users.

You have to follow the rules to use this instance. I don't want to get our instance suspended by other instances and want this to be a pleasant place to be. Please follow our rules and try to be courteous to the fediverse culture in public posts. The rules are available in the "server rules" tab below.

Explicit pornographic content must use a Content Warning, but the extent that you use other CWs is up to you. It is encouraged to CW common topics that bother people when posting on Public. Public posts will show up to people who do not follow you on the federated/local timelines, so be courteous.

Unlisted posts will show up for non-followers if someone reblogs your post, but I think that should be up to the sharer to decide if they want to share an non-CW'd post to their followers. * Please note that people can see unlisted posts if they visit your profile.

Followers-Only posts are only visible to logged-in followers and cannot be reblogged. It's up to you if you want to CW these, only your followers will be able to see them.

FEDERATION POLICY

Denden will blacklist instances that foster hate-speech, harassment, CSAM (child sex abuse material), or anything else that is illegal to host in the United States.

Denden does not use pre-made instance blocklists. There have been too many occasions of blocklists being manipulated by bad actors to include innocent people for me to trust them. Blocked instances are individually vetted by the admins.

We will not blacklist instances based on 'guilt-by-federation': if an instance federates with a "bad" instance, but otherwise does not foster bad behavior (racism/harassment/etc), it will not be blacklisted.

We will also not blacklist an instance solely based on disputes with admins. The actions of admins do not necessarily represent the views of regular users on the instance.

Note: Denden's rules are designed to both foster a pleasant community as well as minimize the likelihood of being blacklisted by other instances. The content mentioned in rule 4 is illegal in France, where many instances are hosted.

Other instances won't be suspended unless they foster hate-speech, harassment, or CSAM. You might see content that you don't like in the federated timeline. Make sure to set filters in your account settings.

Instead of us suspending instances, I encourage you to curate your own instance blocklist. You can block an instance in the same way you can block a user, you will not see anything from the whole instance, and users in that instance will not be able to interact with you.

In the event I need to take the server down for good, I will give everyone at least 3 months notice to export your data and migrate to another server.

MODERATION

If someone is being troublesome, please report them. If they're from another instance, I am able to block them from this instance.

Please only forward reports to a rule-breaker's instance if they are breaking the rules on their instance as well. You are anonymous to other instance's admins in forwarded reports.

About this server

This is a Norwegian mastodon instance and safe haven for social exchange between tech people from the University of Oslo, Norway. Despite that, this site has no affiliation nor it belongs to the University of Oslo.

It is also opened for other tech people and/or friends from around the world, but we have restrictions to posts in other languages (check our rules).

The name "babb" is because of the love for good kebabs that we share at USIT (University Center for Information Technology at the University of Oslo. On our team, we call them affectionally "babb".

It came to us that "babbe" is used pejoratively for immigrants in Sweden - which is kinda ironic, since the admin of this site has indeed and proudly, a foreign background.

Report Handling

Below are rough definitions as to how moderaters will handle reports and what actions will be taken when a user report is submitted. Of course every report will be investigated thoroughly and punishments may be more or less severe based on moderator findings.

User level:

User Silence:Minor infractions, heated arguments, frivolous accusations, and centrist rhetoric will result in the user being silenced. Users may still follow and converse with users that are silenced but their toots will not be federated. User Suspension:Major infractions, multiple and consistent infractions, abuse, hate speech, illegal content, and right wing politics will result in a full suspension. Users will be unable to interact with suspended accounts and, if the account is based on the instance, the user will not be able to log in or post.

Instance level:

Reject Media:Applied to any server that allows illegal content and illicit porn. Can be applied to a server regardless of federated, silenced, or suspended status. Domain Silence:Reserved for instances whose politics are in violation of guideline 3. Currently consists mostly of Libertarian instances and gnu.social instances that have federated. Domain Suspension:Any domain that harbours hate speech, encourages the sharing of illegal content, or where admins have been unwilling to punish users violating guidelines 1 and 2 will be given a full suspension and will no longer be able to federate with our instance.

Suspension of inactive accounts

At the moment, the hosting of this instance is paid for entirely by the admin, which limits how many active accounts we can support. New registrations might therefore close when we approach the limit. To keep us below the limit, the admin will periodically suspend accounts that have not been used in six months. When this is about to happen, these users will get a direct message telling about incoming suspension. After this announcement, they will have 30 days to reply if they wish to continue to keep the account active. If no reply is received in 30 days, the account will be suspended.

Governance

This instance currently has a single admin, but our goal right is to transform the instance into a form of sociocratically organized platform cooperative. A discussion about governance structures is planned; contact the admin if that interests you.
